                  LETTER NO. L‐95‐09                SIXTH FLOOR, 900 HOWE STREET, BOX 250    VANCOUVER, B.C.  CANADA  V6Z 2N3  ERICA M. HAMILTON  TELEPHONE:  (604)  660‐4700  COMMISSION SECRETARY  BC TOLL FREE:  1‐800‐663‐1385  Commission.Secretary@bcuc.com  FACSIMILE:  (604)  660‐1102  web site: http://www.bcuc.com  Log No. 30178, 30768  VIA E‐MAIL  bctc.regulatory@bctc.com  October 15, 2009        British Columbia Transmission Corporation  Suite 1100, Four Bentall Centre  1055 Dunsmuir Street  Vancouver, BC   V7X 1V5    Attention:  Ms. Janet Fraser    Director Regulatory Affairs    Dear Ms. Fraser:    Re:  British Columbia Transmission Corporation  Project Number 3698539  TransCanada Energy Ltd. Complaint regarding Firm Sales to Alberta    This letter is in response to British Columbia Transmission Corporation’s (“BCTC”) letter to the Commission dated  September 17, 2009 seeking clarification of Commission Order G‐103‐09 (“Order”) and the accompanying Decision dated  September 10, 2009 with respect to the TransCanada Energy Ltd. (“TCE”) Complaint.    The Commission also received letters from TCE (September 24, 2009), NorthPoint Energy Solutions Inc. (“NorthPoint”)  (September 22, 2009) and BC Hydro (October 1, 2009).    The Commission hereby confirms its intention to limit Long Term Firm Point‐to‐Point sales to 480 MW, going forward, by  amending those service agreements which contain the subject condition in respect of a further order of the Commission.    The Commission therefore confirms that BCTC is, in consultation with its affected customers, to cancel the 350 MW of LTF  PTP service agreements containing the subject condition, as identified in Table 1 of BCTC’s September 17, 2009 letter, and  allocate 45 MW of LTF PTP service and 305 MW of conditional period‐conditional firm or non‐firm service to the affected  customers in a queue priority consistent with their pre‐existing priority rights.  The Commission further confirms that this  course of action will satisfy the terms of the Order G‐103‐09.  The Commission also confirms that “affected customers”  refers to NorthPoint and British Columbia Hydro and Power Authority.    The Commission expects BCTC to implement the terms of the Order forthwith, without further delay.      Yours truly,      Original signed by:      Erica M. Hamilton  cms  cc:  Mr. Darren Angerman       TransCanda Energy Inc.       alan_ross@transcanada.com    Registered Intervenors  Orders/L‐95‐09_BCTC_Clarification TCE Complaint Decision
