Rhodes, Commissioner August 20, 2009 O R D E R WHEREAS: A. British Columbia Hydro and Power Authority (“BC Hydro”) launched a Clean Power Call on June 11, 2008, and requested in its 2008 Long Term Acquisition Plan (“2008 LTAP”) filed with the British Columbia Utilities Commission (“Commission”) on June 12, 2008 that the Commission endorse the Clean Power Call eligibility requirements and volume target; and B. On May 27, 2009, BC Hydro applied to the Commission for relief from certain requirements of the British Columbia Transmission Corporation (“BCTC”) Transmission Service and Interconnection Service Procedures for Competitive Electricity Acquisition Processes (the “CEAP Procedures”) in relation to the Clean Power Call; and C. The CEAP Procedures are set out in Attachment P to BCTC’s open access transmission tariff and were approved by Commission Order G-58-05; and D. On June 1, 2009, by Commission Order G-63-09, the Commission approved the May 27, 2009 application and determined that for the Clean Power Call only, the requested relief was granted; and E. On August 19, 2009, BC Hydro applied to the Commission for further relief from certain requirements of the BCTC Transmission Service and Interconnection Service Procedures for CEAP Procedures in relation to the Clean Power Call (the “Application”); and F. BC Hydro advised that without the relief requested in the Application, it will be required by section 4.10 of the CEAP Procedures to select the successful Clean Power Call participants and submit an application to BCTC to nominate those successful projects as network resources within four weeks following the date of the Commission’s decision on the 2008 LTAP (July 27, 2009); and . . ./2

The relief requested in the Application is to allow BC Hydro, for the Clean Power Call only, to delay its nomination of the successful projects until on or before December 31, 2009 so that BC Hydro can make its decisions with the benefit of completing its assessment on the status of First Nations consultation for the Clean Power Call projects; and H. BC Hydro advised that there would be no potential harm to third parties if the Commission approves the Application because any risk associated with approval of the Application is solely to BC Hydro, and BC Hydro believes that risk is not significant; and I. The Commission considers that the Application is in the public interest. NOW THEREFORE the Commission determines, for the Clean Power Call only, BC Hydro shall submit an application to BCTC, nominating the successful projects as network resources as required by section 4.10 of the CEAP Procedures, on or before December 31, 2009.
