An Application by Terasen Gas Inc.

for Approval of a Franchise Agreement Extension

with the Municipality of Coldstream

CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

 

WHEREAS:

A.       On January 28, 1991, Terasen Gas Inc. (Terasen Gas) (formerly BC Gas Inc.) entered into a Franchise Agreement with the Municipality of Coldstream (the Municipality) that expired on August 11, 2010 (the Existing Agreement);

 

B.       Terasen Gas and the Municipality have entered into an Amending Agreement which extends the terms and conditions of the Existing Agreement to December 31, 2010 (the Extension Agreement);

 

C.       On August 23, 2010, Terasen Gas applied to the British Columbia Utilities Commission (the Commission) for approval of the Extension Agreement with the Municipality (the Application);

 

D.        The Application requests an extension as agreed of the Franchise Agreement until December 31, 2010;

 

E.        The Commission has reviewed the Application and considers the approval is warranted.

 

 

NOW THEREFORE pursuant to section 45 of the Utilities Commission Act, the Commission approves the extension to the Franchise Agreement as filed.
