An Application by Terasen Gas (Vancouver Island) Inc.

for the Nexen Marketing J. Aron & Company Novation Agreement

O  R  D  E  R

 

A.      On August 26, 2009, the British Columbia Utilities Commission (the Commission), by Letter L-59-09, accepted the Terasen Gas (Vancouver Island) Inc. (TGVI) 2009/10 Annual Contracting Plan; and

B.      On July 14, 2010, TGVI filed with the Commission a partially executed copy of the novation agreement assigning the TGVI and Nexen Marketing GasEDI contract to TGVI and J. Aron & Company (the Agreement); and

C.      The Commission has reviewed the TGVI filing (the Filing) and is satisfied that the Agreement is appropriate and should be accepted for filing; and

D.      TGVI has requested that the details of the Filing be kept confidential for the reasons of commercial sensitivity as noted in the Filing.

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts the novation agreement assigning the TGVI and Nexen Marketing GasEDI contract to TGVI and J. Aron & Company.  TGVI is to file with the Commission the executed copy of the novation agreement.

The Commission will keep confidential the novation agreement identified in this Order.
