O R D E R
WHEREAS:
A. Pursuant to Section 71 of the Utilities Commission Act, on August 27, 2010, FortisBC Inc. (FortisBC) filed with the British Columbia Utilities Commission (the Commission) a Capacity Purchase Agreement (CAPA) with Waneta Expansion Power Corporation (WEPC) in relation to WEPC’s Waneta Expansion Power Project (the Filing);
B. The Commission acknowledges receipt of the justification report for the CAPA which FortisBC included in the Filing;
C. The Commission has considered the Filing and has determined that the CAPA is in the public interest.
D. FortisBC has requested that the CAPA and the justification report be kept confidential due to their commercially sensitive content.
NOW THEREFORE the Commission orders that the Capacity Purchase Agreement, set out in Appendix A to this Order, is accepted for filing as an energy supply contract pursuant to section 71 of the Utilities Commission Act. The Commission will hold confidential the Capacity Purchase Agreement and the justification report.
