O R D E R
WHEREAS:
A. On August 26, 2010, the British Columbia Utilities Commission (Commission) by Letter L-62-10, accepted the Terasen Gas Inc. (Terasen Gas) 2010/11 Annual Gas Contracting Plan;
B. On October 28, 2010, Terasen Gas filed with the Commission a fully executed copy of a GasEDI Base Contract with amendments called, “Standard Provisions of the GasEDI contract for Short Term Sale and Purchase of Natural Gas General Terms and Conditions” negotiated between Terasen Gas and Noble Americas Gas & Power Corp.;
C. Terasen Gas uses the GasEDI Base Contract dated October 26, 2000 for natural gas contracting. The Special Provisions for each gas transaction is confirmed via a deal sheet described in section 9 of the GasEDI Standard Contract;
D. Terasen Gas has requested that the details of the Filing be kept confidential for the reasons of commercial sensitivity;
E.
The Commission has reviewed the Terasen Gas
filing and is satisfied that the Special Provisions to the
GasEDI Base Contract for Short-Term Sale and Purchase of Natural Gas between
Noble Americas Gas & Power Corp. and Terasen Gas is consistent with the
Annual Gas Contracting Plan.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts for filing the executed copy of the Special Provisions of the GasEDI Base Contract negotiated between Terasen Gas and Noble Americas Gas & Power Corp. for the Short Term Sale and Purchase of Natural Gas.
The Commission will keep confidential the Noble Americas Gas & Power Corp. agreement identified in this Order.
