O R D E R
WHEREAS:
A. On September 16, 2010, pursuant to sections 59 to 61 of the Utilities Commission Act (the Act), British Columbia Hydro and Power Authority (BC Hydro) submitted to the British Columbia Utilities Commission (Commission) an application to amend the Open Access Transmission Tariff (OATT) Application. The Application requests approval of amendments to the OATT and related tariff supplements and rate schedules, to reflect the integration of BC Hydro and British Columbia Transmission Corporation (BCTC) pursuant to the Clean Energy Act, S.B.C. 2010, c. 16 (CEA). As part of this Application, BC Hydro also applies to amend certain provisions of the OATT to reflect other housekeeping items;
B. BC Hydro also seeks an order from the Commission granting BC Hydro relief from the terms of Attachment K (Transmission Planning Process) to BC Hydro’s OATT until January 1, 2012. Such relief will allow BC Hydro to fully assess its transmission planning process and determine how it will proceed with compliance with the CEA in conjunction with the Act and the OATT;
C. The Commission has considered the Application and finds the establishment of a regulatory timetable to review the Application is warranted.
NOW THEREFORE the Commission determines as follows:
1. BC Hydro’s OATT customers and other stakeholders may provide a letter of comment on this Application to the Commission Secretary, and a copy to BC Hydro, by no later than November 22, 2010.
2. BC Hydro is directed to provide a copy of this Order to all its OATT customers and those stakeholders who received a copy of this Application by November 10, 2010. In BC Hydro’s cover letter to these customers and stakeholders, BC Hydro should advise that the Commission has issued an order that includes an opportunity for customers and stakeholders to provide a letter of comment on the Application. BC Hydro’s letter should also provide the relevant links on the BC Hydro website to find the Application materials.
3. BC Hydro may provide its response that addresses the letters of comment received, if any, to the Commission Secretary by November 26, 2010.
