O R D E R
WHEREAS:
A. Order G-123-09 approved the Registration Manual for entities subject to adopted Mandatory Reliability Standards and required that entities subject to the standards register with the Commission by December 31, 2009;
B. The Registration Manual requires that the Western Electricity Coordinating Council (WECC) in its role as the Mandatory Reliability Standards Administrator review and recommend registration for all applicable Entities and allow 21 days for Entities to comment to the Commission on the WECC’s recommendations;
C. On May 20, 2010, the WECC recommended to the Commission that the Commission approve Toba Montrose General Partnership registration for the functions of Generator Owner, Generator Operator, Transmission Owner and Transmission Operator based on Toba Montrose four Generating Facilities which have a combined capacity of 260 MVA and are connected to the bulk transmission system at 230 kV;
D. On June 7, 2010, Toba Montrose disputed WECC’s recommendations stating that it believed it should not be required to register for the function Transmission Operator arguing that the Joint operating Order 4T PSY-01 transferred operating responsibility to BCTC;
E. On September 16, 2010, WECC reviewed the operating order and concluded that it did not transfer responsibilities for compliance to BCTC and in fact was explicit in assigning responsibilities for the operation of the equipment owned by Toba Montrose to that entity. The WECC recommended that it not consider the Joint Operating Order an assignment agreement for the transfer of responsibilities;
F. The Commission accepts the analysis of the WECC.
NOW THEREFORE the Commission orders as follows:
1. Functional registration for Toba Montrose General Partnership for the functions of Generator Operator, Generator Owner, Transmission Owner, and Transmission Operator is approved as recommended by the WECC.
2. Toba Montrose has 90 days from the date of this Order to file any mitigation plans for standards with which it is not in compliance.
