O R D E R
WHEREAS:
A. On December 1, 2010, Terasen Gas Inc. (Terasen Gas) applied (the Application) to the British Columbia Utilities Commission(the Commission) pursuant to sections 59 to 61 of the Utilities Commission Act (the Act) for approval of General Terms and Conditions (GT&Cs) for compression and dispensing service for Compressed Natural Gas (CNG) Service and transportation, delivery, fuel storage and dispensing service for Liquefied Natural Gas (LNG) Service that would be used for future service agreements with customers, and for certain Orders relating to cost recovery;
B. In the Application, Terasen Gas also applied pursuant to sections 59 to 61 of the Act, for approval of a Service Agreement with Waste Management of Canada Corporation (Waste Management) for compression and dispensing service for CNG (the WM Agreement);
C. In the Application, Terasen Gas also applied pursuant to section 44.2 of the Act, for acceptance of the expenditures required to provide compression and dispensing service for CNG under the WM Agreement;
D. Terasen Gas seeks an expedited process with respect to approval of the WM Agreement, requesting a permanent rate with respect to provision of CNG service to Waste Management on or before January 14, 2011, or alternatively an interim rate approval pursuant to section 89 of the Act on or before that date;
E. In the Application, Terasen Gas requested that the WM Agreement and the Financial Schedules in Appendix E be confidential since they contain commercially sensitive terms and negotiated rates;
F. The Commission has considered the Application and determines that it should establish a written public hearing process and Regulatory Timetable for the review of the Application and that the Regulatory Timetable should include an expedited written public hearing process to consider the WM Agreement.
NOW THEREFORE the Commission orders as follows:
1. The Application will be examined by a Written Public Hearing process, in accordance with the Regulatory Timetable for the hearing that is established and attached as Appendix A to this Order.
2. Terasen Gas is to publish, as soon as possible, in display-ad format, the Notice attached as Appendix B to this Order in the Vancouver Sun, Province and the Victoria Times Colonist.
3. The Application, together with any supporting materials, will be made available for inspection at the Terasen Gas Office, 16705 Fraser Highway, Surrey, BC, V4N 0E8, and at the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, BC, V6Z 2N3, and will also be made available on the Terasen Gas and Commission websites at www.terasengas.com and www.bcuc.com.
4. Interveners and Interested Parties should register with the Commission, in writing or by electronic submission, by Monday, December 13, 2010. Interveners should specifically state the nature of their interest in the Application, and identify generally the nature of the issues that they intend to pursue during the proceeding and the nature and extent of their anticipated involvement in the review process.
5. The Commission will hold the WM Agreement and the Financial Schedules in Appendix E of the Application confidential, pending a review of whether holding this information confidential is necessary, in the public interest and consistent with sections 59 to 61 of the Act.

NOTICE OF
APPLICATION AND |
The APPLICATION
On December 1, 2010, Terasen Gas Inc. (Terasen Gas) filed an application (the Application) for approval of General Terms and Conditions for compression and dispensing service for Compressed Natural Gas (CNG) Service and transportation, delivery, fuel storage and dispensing service for Liquefied Natural Gas (LNG) Service and for certain orders relating to cost recovery. The Application also requested approval of a CNG Service Agreement with Waste Management Canada Corporation and the expenditures to provide service under this agreement, and asked that this Service Agreement receive expedited approval by January 14, 2011.
THE REGULATORY PROCESS
The Commission has established a Written Public Hearing and Regulatory Timetable for the regulatory review of the Application. The Regulatory Timetable can be viewed on the Commission’s web site at www.bcuc.com.
Intervention
Persons who expect to actively participate in the Terasen Gas proceeding should register as Interveners with the Commission, and should identify the issues that they intend to pursue as well as the nature and extent of their anticipated involvement in the review process. Interveners will each receive an email notice of all correspondence, filed documentation and should provide an email address, if available. Persons not expecting to actively participate, but who have an interest in the proceeding, should register as Interested Parties. Interveners and Interested should register in writing, no later than Monday, December 13, 2010. Notification by mail, courier delivery, facsimile or email is acceptable.
All submissions and/or correspondence received from active participants or the general public relating to the Application will be placed on the public record and posted to the Commission’s website.
