Re:  FortisBC Inc.

Project No. 3698564/Order G-139-09

2009 Rate Design Application and Cost of Service Study

By letter dated June 7, 2010 Zellstoff Celgar (Celgar) wrote the Commission concerning certain information requests (IRs) submitted to FortisBC Inc. (FortisBC) pursuant to Order G-86-10.  Celgar identified the specific IRs it objects to (the Contentious IRs) and gave reasons for its objections.

Before ruling on the Contentious IRs, the Commission Panel will provide FortisBC and Interveners the opportunity to comment on Celgar’s objections to those IRs.  FortisBC and Interveners are invited to make submissions on the following:

         Whether the Contentious IRs are in scope;

         Whether the Contentious IRs raise new issues;

         Whether allowing the Contentious IRs necessitates further process, and if so, what further process would be necessary.

Submissions must be filed with the Commission by noon, Monday, June 14, 2010.  Celgar must file its reply, if any, by noon, Thursday, June 17, 2010.

Following the receipt of submissions, the Commission Panel will determine whether FortisBC needs to respond to all or, any, of the Contentious IRs.

The Commission Panel expects to issue its determination on further process concurrently with its determination on the Contentious IRs.  The response date, if any, for the Contentious IRs will be included in the Order on further process.

Finally, Appendix "A" to Commission Order G-86-10 specifies that FortisBC is to respond to the IRs on Exhibits B-33 and B-35 by Wednesday, June 16, 2010.  The Commission Panel still requires FortisBC to respond to the non-Contentious IRs on Exhibits B-33 and B-35 by that date.

                                                                                                                                Yours truly,
