By letter dated February 11, 2010, counsel for Nlaka’pamux Nation Tribal Council (NNTC) informed the British Columbia Utilities Commission (Commission) that the NNTC would be delayed in submitting the evidence that was the subject of the Undertaking of January 29, 2010 (T16: 2402-04) while a new key was ordered for a safe in which the evidence was locked. Counsel for the NNTC further advised that the only evidence that might be in the safe was an audio and video recording from the September 13, 2007 meeting in Lytton (Exhibit C5-24).
By letters dated February 22, 2010, both BC Transmission Corporation (BCTC) and BC Hydro and Power Authority (BC Hydro) requested an opportunity to address any issues arising from any relevant evidence found in the safe in their Reply Submissions given that the evidence would likely not be produced before their Final Argument deadline of February 26, 2010 (Exhibits B-33 and C3-53).
By letter dated March 26, 2010, NNTC provided copies of a video of the September 13, 2007 meeting to the Commission, BC Hydro, BCTC and counsel for Coldwater et al (Exhibit C5-25).
The Commission Panel accepts BCTC’s and BC Hydro’s requests to respond to the video evidence in their Reply Submissions on April 19, 2010.
