Re: Planet Energy (B.C.) Corp.

Additional Information Required - Application for a Licence to Market Natural Gas

The BC Utilities Commission (“Commission”) is in receipt of Planet Energy (B.C.) Corp.’s (“Planet Energy”) Application for a Licence to Market Natural Gas dated December 15, 2009.  The Commission could not proceed in reviewing the Application due to incomplete submission of Licence Requirements (“Requirements”).

The Commission requests that Planet Energy file with the Commission the following:

•         Financial Statements – A copy of the audited financial statement for the most recently ended fiscal year and copies of all subsequent unaudited statements for each concluded financial quarter following the most recently ended fiscal year for the Licence Applicant, Planet Energy (B.C.) Corp.  This is pursuant to Item 5 of the Requirements;    

•         Copies of all licences to carry on business in BC, pursuant to Item 7 of the Requirements; and

•         Information on Planet Energy’s gas supply arrangements with its suppliers, pursuant to Item 12 of the Requirements.

Planet Energy’s Application included consolidated financial statements of Planet Energy Corp., the Applicant’s parent company.  For the purposes of reviewing your Application, the Commission requires the financial statement of the Applicant.  Further, the wording in the submitted Letter of Credit must be amended: 

a) Change the expiry date to October 31, 2010 to coincide with the licence year;

b) Delete “dated and signed by Minister of Finance,” first paragraph, third line; and

c) Add the phrase “and multiple presentations” after Partial drawings, fifth paragraph, first line.

In addition to this required information, the Commission requests:

•         A brief curriculum vitae of yourself, as well as Mr. Paul J. DeVries; 

•         A description of gas marketing activities, if any, of Planet Energy (B.C.) Corp. from July 3, 2008 to present; and

•         Contact information of references from Enbridge Gas Distribution Inc. and Union Gas.

Review of Planet Energy’s Application will be held pending receipt of the requested information.
