DB Commodities Canada Ltd. GasEDI Base Contract

O  R  D  E  R

WHEREAS:

A.      On August 26, 2010, the British Columbia Utilities Commission (Commission) by Letter L-62-10 accepted for FortisBC Energy Inc. (FortisBC Energy) (formerly Terasen Gas Inc.) the 2010/11 Annual Contracting Plan;

B.      On August 25, 2011, FortisBC Energy filed with the Commission a fully executed copy of a GasEDI Base Contract with amendments called, “Standard Provisions of the GasEDI Contract for Short-Term Sale and Purchase of Natural Gas General Terms and Conditions” negotiated between FortisBC Energy and

DB Commodities Canada Ltd. (DB Contract);

C.      FortisBC Energy uses the GasEDI Base Contract dated October 26, 2000 for natural gas contracting.  The Special Provisions for each gas transaction is confirmed via a deal sheet described in section 9 of the GasEDI Standard Contract;

D.      FortisBC Energy requested that the details of the subject filing be kept confidential for the reasons of commercial sensitivity set out in the filing;

E.       The Commission has reviewed the subject filing and is satisfied that the DB Contract is consistent with the Annual Contracting Plan and that the Standard Provisions of the DB Contract do not differ materially from the set of Standard Provisions typically used by FEI and executed contract.

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts for filing the executed copy of the Special Provisions of the GasEDI Base Contract negotiated between FortisBC Energy Inc. and DB Commodities Canada Ltd. for the Short Term Sale and Purchase of Natural Gas.  The Commission will keep confidential the DB Commodities Canada Ltd. Agreement identified in this Order.
