of Natural Gas Supply Contracts for the Commodity and Midstream Portfolios

for the 2011/12 Contract Year

O  R  D  E  R

WHEREAS:

 

A.      On September 1, 2011, the British Columbia Utilities Commission (Commission) by Letter L-69-11 accepted for FortisBC Energy Inc. (FEI) the 2011/12 Annual Gas Contracting Plan (ACP);

 

B.      On October 25, 2011, FEI filed with the Commission for acceptance the Commodity term supply allocation between monthly and daily priced contracts as well as the monthly and daily market premiums for Commodity baseload and seasonal transactions not yet accepted by the Commission (Commodity Portfolio Filing);

 

C.      On October 25, 2011, FEI filed with the Commission for acceptance the Midstream supply allocation between monthly and daily priced contracts as well as the monthly and daily market premiums for Midstream seasonal transactions, and newly executed and approved storage and redelivery contracts were also referenced for informational purposes (Midstream Portfolio Filing);

 

D.      On December 13, 2011, FEI submitted to the Commission for acceptance amended filings, replacing the October 25, 2011 Commodity Portfolio Filing and Midstream Portfolio Filing in their entirety;

 

E.       FEI requests that the details of the Commodity Portfolio Filing and the Midstream Portfolio Filing (the FEI Filings) be kept confidential for the reasons of commercial sensitivity as noted in the Filings;

F.       The Commission reviewed the FEI Filings and is satisfied that the Commodity and Midstream supply allocation, the Commodity and Midstream gas supply contract premiums, and the storage and redelivery contracts are appropriate considering market prices at the time they were negotiated, and are consistent with the ACP.

 

 

NOW THEREFORE pursuant to Section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts the natural gas contracts shown in Attachment A to this Order.  The Commission will keep the information in the FEI Filings confidential.
