to Terminate Gas Marketer Licence A-24-10

O  R  D  E  R

 

WHEREAS:

 

A.    On August 30, 2010, Just Energy (B.C.) Limited Partnership (Just Energy) applied to the British Columbia Utilities Commission (Commission) for approval to complete the transfer and assignment of all Universal Energy Corporation’s (Universal) Commodity Unbundling Service Consumer Agreements;

 

B.    Article 29 of the Code of Conduct for Gas Marketers, Transfer of Agreements requires that the assignment, sale or transfer of a Gas Marketer’s Consumer agreements to another Gas Marketer must be approved in advance by the Commission;

 

C.    By Order No. A-18-10 dated September 16, 2010, the Commission approved the acquisition of all Universal’s Customer Contracts by Just Energy;

 

D.    On April 7, 2011, Universal applied to the Commission to terminate its gas marketer licence A-24-10 effective April 15, 2011.  Universal confirmed that all customers under this entity were successfully transferred to Just Energy and stated that FortisBC confirmed to them that there are no gas supply issues or considerations with respect to terminating Universal’s licence;

 

E.    The Commission has reviewed Universal’s application and considers approval is warranted.

 


 

 

NOW THEREFORE pursuant to section 71.1(6) of the Utilities Commission Act the Commission approves the termination of Universal’s Gas Marketer Licence A-24-10, effective immediately.
