CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

 

WHEREAS:

 

A.      British Columbia Utilities Commission (Commission) Order C-4-93 approved a Standard Form Franchise Agreement (Franchise Agreement) between BC Gas Utility Ltd. (BC Gas) and the District of Sparwood (Municipality) dated August 6, 1991.  The Franchise Agreement expired on September 9, 2011;

 

B.      On September 27, 2011, FortisBC Energy Inc. (FEI) [formerly known as BC Gas and Terasen Gas Inc.] applied to the Commission for approval of an Operating Agreement (Agreement) between FEI and the Municipality, effective September 9, 2011 (Application);

 

C.      The Commission has reviewed the Application and considers that approval is warranted.

 

 

NOW THEREFORE the Commission, pursuant to section 45 of the Utilities Commission Act, approves the Operating Agreement as filed.
