O  R  D  E  R

WHEREAS:

A.       On June 30, 2011, FortisBC Inc. (FortisBC or the Company) filed with the British Columbia Utilities Commission (Commission) an application for approval of its 2012 – 2013 Revenue Requirements and the review of its 2012 Integrated System Plan (collectively referred to as the Application);

B.     In accordance with Order G-111-11, two rounds of Commission and Intervener Information Requests (IR) were issued to FortisBC on August 10 and on September 30, 2011.  FortisBC responded to IR No.1 on September 9 and will respond to IR No. 2 on October 21, 2011;

C.     FortisBC proposed that the Application proceed through a negotiated settlement process, or alternatively, by way of a written hearing process;

D.    According to the terms of the Company’s Performance-Based Regulation Plan for 2011, an Annual Review is required to assess the Company’s forecast 2011 financial results and non-financial performance;

E.     The Commission considers establishing a date for a Procedural Conference and setting a formal process to review intervener evidence is necessary and in the public interest.  Other procedural items are also established in Appendix A to this Order.

NOW THEREFORE the Commission orders as follows:

1.       A Revised Preliminary Regulatory Timetable for this Application is set out in Appendix A to this Order.  If a negotiated settlement process is established, it may proceed as early as December 7, 2011.  If this Application proceeds by way of a written or oral hearing, these dates will be set subject to a further Order establishing the review process.

2.       Interveners intending to apply for participant assistance must submit a budget estimate by Thursday, December 1, 2011 consistent with the Commission’s Participant Assistance/Cost Award Guidelines and Order G‐72‐07.  Copies are available upon request, or can be downloaded from the Commission’s website at http://www.bcuc.com.
