2011 Revenue Requirements Application

In response to Pacific Northern Gas Ltd.’s (PNG) filing of Exhibit B-9 in the above proceeding, the Commission Panel is not satisfied that the response provided is sufficient information for a transparent review of PNG’s proposed Consolidated Gas Tariffs.

The Commission Panel notes that Staff’s Information Request (IR) No. 1.1 in Exhibit A-6, specifically seeks a side-by-side comparison of PNG’s existing wording to the proposed wording for each section of the tariffs.  An explanation to the nature and effect on the customer was also requested.  The Commission Panel does not believe that the response filed as Exhibit B-9 appropriately addresses the information requested.  The Panel is concerned that customers who do not have access to PNG’s existing tariffs would be able to clearly understand the impact of the wording changes without this comparative information.  In addition, the Panel does not believe that a black-line version of FortisBC Energy’s Tariff is sufficient since each utility operates under a different service area with a different customer base and customer concerns.

The Commission Panel also notes that PNG was granted ample time to provide the requested information as the timetable for response to IR No. 1 was extended from February 25 to March 4 in L-6-11 and PNG subsequently filed the completed response on March 17, 2011.

The Commission Panel directs PNG to file the required information by April 8, 2011.  The Regulatory Timetable is amended and attached as Appendix A to this letter to accommodate for a second round of IRs upon receipt of this information.
