Large General Service Rate Tariff Supplement No. 82
__Letter Requesting Clarification or Reconsideration of Order G-213-11__
On December 13, 2011, the Commission approved British Columbia Hydro and Power Authority’s (BC Hydro) application for Tariff Supplement (TS) No. 82, subject to certain revisions (see Order G-213-11 and particularly Paragraph 4).
By letter dated December 22, 2011, BC Hydro advised the Commission that it would not be able to comply with the 20-day time limit to process the related outstanding customer applications as directed by Order G-213-11. BC Hydro’s letter also included four issues with respect to clarity and scope. BC Hydro submitted that it could not draft the necessary tariff language and file the tariff supplement with the Commission until the issues it described were resolved. BC Hydro stated that it had no intention to seek reconsideration in regard to the substance of the directives of Order G-213-11, and suggested that each issue could be resolved quickly and without controversy. However, BC Hydro also said that it was not certain if the issue of revising the eligibility threshold to account for GHG-reducing or efficiency investments might well be a substantive reconsideration.
As a result, the Commission issued L-2-12 dated January 5, 2012, accepting for filing an interim TS No. 82 that includes neither the provision required by Paragraph 4 of Order G-213-11 nor the tariff language necessary to address the four issues identified in BC Hydro’s letter, pending a clarification or reconsideration application by BC Hydro at a later date.
On January 27, 2012, BC Hydro filed a letter with the Commission proposing to deal with the four issues it described in its December 22, 2011, letter. BC Hydro submits that if its proposals contained in the January 27, 2012, letter and as shown in the attached TS No. 82 are consistent with the Commission’s thinking and intentions behind Order G-213-11 and the accompanying Reasons, BC Hydro proposes a process to provide Interveners with the opportunity to comment.
The Commission Panel has reviewed BC Hydro’s letter dated January 27, 2012, and considers that BC Hydro’s proposed language in the TS No. 82 that is attached to its letter, reflects the Commission’s thinking and intentions. By this Letter L‑7‑12, all Parties are invited to comment on BC Hydro’s letter dated January 27, 2012, and the revised TS No. 82 as attached. Interveners should provide their submissions no later than Friday, February 17, 2012, and BC Hydro should provide its reply submission on or before Friday, February, 24, 2012.
