Amendment to BC Hydro Electricity Purchase Agreement with Tembec, a general partnership

for the Skookumchuk Power Project

O  R  D  E  R

WHEREAS:

A.      Pursuant to section 71 of the Utilities Commission Act, on August 3, 2012, British Columbia Hydro and Power Authority (BC Hydro) filed the following amendment (Amendment) to the existing energy supply contract that was previously filed with, and accepted by, the British Columbia Utilities Commission (Commission):

B.      Appendix A provides a summary of the Amendment.  Included with the Application, BC Hydro submitted Attachment 4, Schedule B ‐ Summary of EPA Contractual Developments, that sets out certain contractual developments related to other electricity purchase agreements that BC Hydro considers are not amendments to the agreements, and which are listed in Appendix B to this Order;

C.      BC Hydro filed an Application to amend Tariff Supplement No. 74 on November 2, 2012, after this Application was filed with the Commission;

D.      BC Hydro states in the filing that, in their view, the financial impact, if any, of the Amendment on BC Hydro and its ratepayers is low;

E.       The Commission considered the Application by BC Hydro in relation to section 71(2.2) of the Utilities Commission Act;

F.       The Commission has reviewed the filing and determined that the Amendment is in the public interest.

NOW THEREFORE, given that the financial impact, if any, of the Amendment on BC Hydro and its ratepayers is low, pursuant to section 71 of the Utilities Commission Act, the Commission orders that the BC Hydro Electricity Purchase Agreement Amendment with Tembec for the Skookumchuk Power Project, effective March 30, 2012, is accepted for filing.
