O  R  D  E  R

WHEREAS:

 

A.      Order E-18-12 dated April 26, 2012 from the British Columbia Utilities Commission (Commission) accepted for filing the April 5, 2012 Energy Management Services Agreement between Pacific Northern Gas Ltd. (PNG) and FortisBC Energy Inc., which expired on March 31, 2013;

 

B.      On March 18, 2013, PNG submitted the Energy Management Services Agreement with Tenaska Marketing Canada dated March 18, 2013, which has a term from April 1, 2013 to March 31, 2018 (Tenaska EMSA).  On March 21, 2013, PNG withdrew this filing;

 

C.      On March 22, 2013, PNG re-submitted the Tenaska EMSA for Commission acceptance and on March 28, 2013, filed a letter providing clarification of certain matters;

 

D.      In the March 22, 2013 filing, PNG requested that the Tenaska EMSA and related filings be kept confidential and provided reasons in support of its request;

 

E.       The Commission has reviewed the filings and is satisfied that the Tenaska EMSA is in the public interest and that the Tenaska EMSA and related filings should be held confidential.

 

 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts for filing the Energy Management Services Agreement with Tenaska Marketing Canada.  The Tenaska Energy Management Services Agreement and related filings will be held confidential.
