O R D E R

WHEREAS:

 

A.      FortisBC Energy Inc. (FEI) uses the GasEDI Base Contract dated October 26, 2000, together with FEI’s set of Standard Provisions as the starting point for negotiation with counterparties with whom FEI wishes to execute off-system sales or purchase agreements.  The GasEDI Base Contract and FEI’s Standard Provisions are set out in Rate Schedule 30 as approved in British Columbia Utilities Commission (Commission) Order G‑197-11 dated November 28, 2011.  Each gas purchase or sale transaction is then confirmed via a deal sheet described in section 9 of the GasEDI Base Contract;

 

B.      By Letter L-45-12 dated August 2, 2012, the Commission accepted the FEI 2012/13 Annual Contracting Plan (ACP);

 

C.      On April 15, 2013, FEI filed with the Commission a fully executed copy of a GasEDI Base Contract with amendments called “Standard Provisions to The GasEDI Contract for Short-Term Sale and Purchase of Natural Gas” with the Special Provisions negotiated between FEI and Chevron Canada Resources;

 

D.      FEI requested that the filing and associated documents remain confidential due to their commercially sensitive nature;

 

E.       The Commission reviewed the FEI filing and is satisfied that the Special Provisions to the GasEDI Base Contract for Short Term Sale and Purchase of Natural Gas between FEI and Chevron Canada Resources are consistent with the ACP and in the public interest.


 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the British Columbia Utilities Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts for filing the executed copy of the Special Provisions of the GasEDI Base Contract negotiated between FortisBC Energy Inc. and Chevron Canada Resources for the Short Term Sale and Purchase of Natural Gas.  The Commission will keep the FortisBC Energy Inc. filing and associated documents confidential to protect commercially sensitive information.
