O R D E R
WHEREAS:
A. On March 22, 2012, the British Columbia Utilities Commission (Commission) issued Order C-4-12 granting British Columbia Hydro and Power Authority (BC Hydro) a Certificate of Public Convenience and Necessity (CPCN) to serve the community of Hartley Bay, conditional on BC Hydro taking over and owning the distribution system in Hartley Bay;
B. On December 14, 2012, BC Hydro filed with the Commission, pursuant to section 71 of the Utilities Commission Act, the Electricity Purchase Agreement between BC Hydro and Gitga’at Economic Limited Partnership made as of November 21, 2012 (EPA);
C. On December 20, 2012, the Commission issued Letter L-72-12 to BC Hydro and copied to stakeholders, Gitga’at Nation and Gitxaala Nation requesting comments on the EPA by January 31, 2013;
D. On February 5, 2013, BC Hydro informed the Commission that comments were received from B.C. Sustainable Energy Association (BCSEA) only. BCSEA is supportive of the EPA;
E. The Commission has considered the filing by BC Hydro and has determined that the EPA is in the public interest and that BC Hydro First Nations consultations were adequate.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act, the Commission orders the Electricity Purchase Agreement between BC Hydro and Gitga’at Economic Limited Partnership, made as of November 21, 2012, is in the public interest and is accepted for filing.
