O  R  D  E  R

WHEREAS:

 

A.      On September 4, 2013, the British Columbia Utilities Commission (Commission) issued Order G-151-13 which established an amended regulatory timetable for review of FortisBC Inc.’s (FortisBC) Performance Based Ratemaking Revenue Requirements for the years 2014-2018 proceeding (Application);  

 

B.      On October 1, 2013, Mr. Norman Gabana issued a letter to the Commission with comments pertaining to the FortisBC’s Information Request responses to his questions 1,4, 1.5, and 1.12 (complaint);

 

C.      By letter dated October 4, 2013, the Commission requested comments from FortisBC regarding this complaint by October 7, 2013, which may be followed by further comments from Mr. Gabana by October 9, 2013;

 

D.      FortisBC submits that certain questions do not relate to the current Application and therefore declines to respond to questions 1.4 and 1.5 posed by Mr. Gabana.  FortisBC also submits that there were discrepancies between Mr. Gabana’s original question 1.12 and the reasoning posed in his October 1, 2013 letter;

 

E.       No further comments were received by Mr. Gabana;

 

F.       The Commission Panel has reviewed the respective submissions and finds that a determination is necessary.

 

NOW THEREFORE the Commission orders as follows:

 

1.       The Panel finds that Mr. Gabana’s questions 1.4 and 1.5 are out of scope for this Application and determines that a response by FortisBC is not required.

 

2.       For question 1.12, the Panel recommends that Mr. Gabana provide a proper reference for the intended question and submit in the second round in accordance with the amended regulatory timetable set out in Commission Order G-151-13.
