WHEREAS:

A.      On July 17 2013, the British Columbia Utilities Commission (Commission) issued order G-109-13 which established the regulatory timetable for review of FortisBC Inc.’s (FortisBC) Performance Based Ratemaking Revenue Requirements for the years 2014-2018 proceeding (Application);

B.      On August 22, 2013, the Canadian Office and Profession Employees’ Union Local 378 (COPE) submitted supplementary information requests (Supplemental IRs) one day after the IR deadline;

C.      By letter dated August 22, 2013, FortisBC objected to the Supplement IRs by COPE stating that the IRs are outside the scope of what is reasonably required to review the Application.  FortisBC also notes some administrative problems with the Supplemental IRs in terms of referencing;

D.      By letter dated August 23, 2013, the Commission Panel asked FortisBC to provide a more fulsome justification as to the scope of the Supplemental IRs and also invited interveners to provide their views to the Commission by August 28, 2013;

E.       Submissions on this matter were received by FortisBC, British Columbia Pensioners’ and Seniors’ Organization et al, BC Sustainable Energy Association, and COPE.  In addition, COPE also provided comments and corrections to their Supplemental IRs on August 28, 2013;

F.       The Commission has reviewed all submissions and determines that FortisBC should respond to the Supplemental IRs.

NOW THEREFORE the Commission orders as follows:

1.       FortisBC Inc. is directed to respond to the Canadian Office and Profession Employees Union Local 378’s Supplemental IRs.

2.       An extension shall be granted to FortisBC Inc. to respond by September 27, 2013.

DATED at the City of Vancouver, in the Province of British Columbia, this          4th            day of September, 2013.
