Biomethane Third-Party Suppliers Regulatory Process:

Applications for Approval of Third-Party Suppliers’ Rates and

Acceptance of FEI Biomethane Supply Agreements with Third-Party Suppliers and

FEI Capital Expenditures for Related Interconnection Facilities

On February 28, 2013, the Commission issued Order G-29-13, which conditionally increased the supply cap set by Order
G-194-10 by an amount sufficient to accommodate the supply from the four biomethane suppliers:  Dicklands Farms, Seabreeze Farm Ltd., Earth Renu Energy Corp. and the Greater Vancouver Sewerage and Drainage District (part of Metro Vancouver).  Commission Order G-29-13 also directed FEI to confirm to the Commission by March 6, 2013, that natural gas non-bypass customers would bear no actual or potential risk for unsold biomethane pending the outcome of the 2012 Biomethane Application.

On March 4, 2013, the Commission issued Order G-30-13 conditionally establishing a Regulatory Timetable for an expedited biomethane third-party suppliers regulatory process.

In response to Order G-29-13, FEI filed a letter with the Commission on March 6, 2013.  The letter stated that FEI would not assume the economic risk over the lives of the four supply contracts, subject to the possibility of the Commission absolving it of this risk in its decision on the 2012 Biomethane Application.  FEI’s letter also requested that the Commission reconsider the need for FEI to assume the economic risk on the four supply contracts and that it be confirmed that any risk of oversupply be borne by all non-bypass customers subject to a finding that FEI has acted imprudently.

By this letter, the Commission wishes to inform the registered participants in the Third-Party Suppliers Regulatory Process that the proceeding is suspended until further notice.

                                                                                                                                Yours truly,

                                                                                                                                Erica Hamilton
