ORDER
WHEREAS:
A. On June 13, 2016, Sun Peaks Utilities Co., Ltd. (SPUCL) filed an application for approval of an increase of $0.33 per gigajoule in the Gas Delivery Charge effective August 1, 2016, for all Rate Groups (Residential, Small Commercial and Large Commercial) (Application);
B. In its Application, SPUCL also applied for approval of certain changes to its Terms and Conditions of the Gas Tariff and updates to fees charged for specific services;
C. On June 30, 2016, the Commission issued Order G-102-16 establishing a regulatory timetable for the review of the Application, which included one round of information requests ;
D. No interveners registered in this proceeding;
E. SPUCL provided its responses to the Commission’s Information Request on August 10, 2016, and also provided responses to Commission staff questions in its letter dated September 8, 2016; and
F. The Commission reviewed the Application and determines that approval of the increase of $0.33 per gigajoule in the Gas Delivery Charge is warranted. The Commission also reviewed the wording changes to SPUCL’s Terms and Conditions in its Gas Tariff.
NOW THEREFORE the British Columbia Utilities Commission orders as follows:
1. Pursuant to sections 59-61 of the Utilities Commission Act, Sun Peaks Utilities Co., Ltd.’s application for an increase of $0.33 per gigajoule for its Gas Delivery Charge, effective August 1, 2016, is approved on a permanent basis as follows:
a. Rate Group 1 Residential: $2.8175 per gigajoule
b. Rate Group 2 Small Commercial: $2.8175 per gigajoule
c. Rate Group 3 Large Commercial: $3.3175 per gigajoule
2. The changes to the Terms and Conditions are approved as filed in the Application, with the exception of Section 2.4. The proposed wording in Section 2.4 of the Terms and Conditions is denied on the basis that no persuasive evidence has been provided to demonstrate that it is within the Commission’s jurisdiction to approve this section.
3. Sun Peaks Utilities Co., Ltd. is directed to file amended tariff pages with the Commission within 10 business days of the issuance of this order.
