ORDER
WHEREAS:
A. On January 31, 2017, British Columbia Hydro and Power Authority (BC Hydro) filed with the British Columbia Utilities Commission (Commission) an application for extension to the filing date of the Hugh L Keenleyside (HLK) Project Final Report (Final Report) from January 31, 2017 to July 31, 2017 (Application). The Application would vary Directive 5 of Order G-177-10, which required BC Hydro to file with the Commission the Final Report within six months of the end or substantial completion of the HLK Project;
B. On July 16, 2010, BC Hydro filed an application with the Commission under section 44.2(1)(b) for acceptance, pursuant to section 44.2(3)(a) of the Utilities Commission Act (the UCA), that capital expenditures which BC Hydro anticipated making in respect of the HLK Project were in the public interest;
C. The HLK Project had an expected capital cost of $90.2 million and authorized capital cost of $102.0 million. The HLK Project involves the refurbishment of four spillway gates and eight low level outlet gates at Hugh Keenleyside Dam with an initial completion in December 2013;
D. On December 2, 2010, the Commission issued Order G-177-10 accepting the expenditures required by BC Hydro to complete the HLK Project in the amount of $90.2 million were in the public interest in accordance with section 44.2(3)(a) of the UCA;
E. On January 29, 2016, BC Hydro filed its Semi-Annual Progress Report No. 10 which amongst other things, specified it would be the last semi-annual report as the HLK Project is in service and expected to complete the remaining work and project completion activities by July 31, 2016 and the Final Report for the HLK Project would be submitted by January 31, 2017;
F. On March 7, 2017, BC Hydro submitted to the Commission further reasons for the Application including that it required additional time to complete outstanding deficiency work prior to filing the HLK Project Final Report; and
G. The Commission reviewed the Application and has determined a variance to Directive 5 of Order G-177-10 is warranted.
NOW THEREFORE pursuant to section 99 of the Utilities Commission Act, the British Columbia Utilities Commission approves British Columbia Hydro and Power Authority’s application to vary Directive 5 of Order
G-177-10 by extending the filing date of the Hugh L Keenleyside Project Final Report from January 31, 2017 to July 31, 2017.
