ORDER
WHEREAS:
A. On June 7, 2017, the Insurance Corporation of British Columbia (ICBC) filed an application with the British Columbia Utilities Commission (Commission) requesting an extension to the filing deadline for a report on neighbourhood golf cart use directed by Order G-139-16, from October 31, 2017 to July 31, 2018 (Application);
B. By Order in Council No. 606/16, approved and ordered on August 11, 2016, the Lieutenant Governor approved amendments to Division 24 of the Motor Vehicle Act Regulation (MVAR) that added neighbourhood golf cart use to the permitted uses for golf carts in the Village of Chase and in the Town of Qualicum Beach, effective September 6, 2016;
C. By Order G-139-16 dated August 25, 2016, the Commission approved amendments to ICBC’s Basic insurance tariff related to the expansion of permitted uses of golf carts in specific municipalities, effective September 6, 2016;
D. Directive 2 of Order G-139-16 directed ICBC to file a report with the Commission, by no later than October 31, 2017, to assess the adequacy of the rate class used for neighbourhood golf cart use. The report is to include an assessment of the claims experience against the premiums charged and any relevant external information;
E. In the Application, ICBC advises that the provincial government took additional time to address concerns it had heard on neighbourhood golf cart use. Golf cart use only becomes fully operational with the implementation of additional MVAR amendments effective June 5, 2017, and the passing of any applicable municipal bylaws in the Village of Chase and Town of Qualicum Beach; and
F. The Commission reviewed the Application and considers that approval of the extension request is warranted.
NOW THEREFORE pursuant to section 77 of the Utilities Commission Act, the British Columbia Utilities Commission approves the Insurance Corporation of British Columbia’s request for an extension to the filing deadline for a report on neighbourhood golf cart use directed by Order G-139-16, from October 31, 2017 to July 31, 2018.
