ORDER

 

WHEREAS:

 

A.      On September 11, 2017, Creative Energy Vancouver Platforms Inc. (Creative Energy) filed an application with the British Columbia Utilities Commission (Commission) for approval to amend and restate its credit facility agreement with the Royal Bank of Canada (RBC) dated September 6, 2016 (2016 Credit Facility Agreement) by way of an agreement with RBC dated August 1, 2017 (Credit Facility Amendment Agreement), pursuant to sections 50(2) and 50(3) of the Utilities Commission Act (Application);

B.      The Credit Facility Amendment Agreement amends and restates the 2016 Credit Facility Agreement, which was approved by Order G-184-16 dated December 8, 2016;

C.      On September 22, 2017, Creative Energy filed responses to Commission staff questions regarding the Application; and

D.      The Commission has reviewed the Application and considers that approval should be granted.

 

NOW THEREFORE pursuant to section 50 of the Utilities Commission Act, the Commission orders as follows:

 

1.       Creative Energy’s application to amend and restate its 2016 Credit Facility Agreement with RBC is approved, as set forth in the Application.

2.       Creative Energy must file with the Commission a copy of the final accepted Credit Facility Amendment Agreement within ten days of its acceptance by Creative Energy.
