Application for Approval of a Letter Agreement to Extend the Termination Provision in the Transportation Service Agreement between FortisBC Energy Inc. and the Vancouver Island Gas Joint Venture

ORDER

WHEREAS:

A.      On August 2, 2018, pursuant to section 89 of the Utilities Commission Act, FortisBC Energy Inc. (FEI) filed an application with the British Columbia Utilities Commission (BCUC) for interim approval of a proforma (unexecuted) letter agreement (Proforma Amending Agreement), extending the provision for early termination by the Vancouver Island Gas Joint Venture (VIGJV) upon written notice to FEI by December 31, 2018;

B.      An extension to the early termination provision to December 31, 2018 will provide sufficient time for FEI and VIGJV to complete a consultation process and to identify potential imbalance return business practices and allocation procedures.

C.      All other terms of the Transportation Service Agreement (TSA) remain unchanged; and

D.      The BCUC has reviewed the Proforma Amending Agreement and considers that approval is warranted.

NOW THEREFORE pursuant to section 89 of the Utilities Commission Act, the BCUC orders as follows:

1.       The Proforma Amending Agreement between FEI and the VIGJV amending the early termination provision in the TSA to December 31, 2018, is approved on an interim basis.

2.       FEI is to file the amending agreement, once executed by the parties, with the BCUC for permanent approval.
