ORDER
WHEREAS:
A. On November 19, 2018, NorthRiver Midstream Partners (NRMP) advised the British Columbia Utilities Commission (BCUC) that Spectra Energy Midstream had changed its name to NorthRiver Midstream Partners;
B. By Order G-138-07 dated November 27, 2007, the BCUC continued and reissued the exemption approvals given under Order G-30-06 in the name of Spectra Energy Midstream;
C. By Order G-25-08 dated February 26, 2008, the BCUC continued and reissued the exemption approvals given under Order G-138-07 and revised Appendix I to Order G-138-07 to include natural gas processing and pipeline facilities in the West Doe area of northeast British Columbia; and
D. Section 99 of the Utilities Commission Act (UCA) provides that the BCUC may reconsider, vary or rescind an order made by it.
NOW THEREFORE pursuant to section 99 of the UCA, the BCUC orders as follows:
1. The exemption approvals given under Order G-25-08, not including the exemption for the Sunrise area, are continued and reissued in the name of NorthRiver Midstream Partners.
2. The facilities identified in Appendix A will continue to be regulated under the UCA on a complaint basis, with a complaint taking a form similar to that of an application by an interested party under the Common Carrier and Common Processor sections of Part 4 of the UCA with respect to facilities operated by a person declared to be a common carrier or common processor.
3. NRMP is directed to advise the BCUC, in writing, of any facility that is not listed in Appendix A and which NRMP intends to use to transport and process natural gas for others, so that the BCUC, on finding that the exemption of such facility is in the public interest may, by order, issue a revised Appendix A.
4. NRMP is responsible for the safe and proper operation of its facilities consistent with the requirements of the Pipeline Act and other regulatory requirements.
5. NRMP is directed to file an annual report regarding each exempted facility in the form set out in Appendix B or as the BCUC may otherwise require, and to distribute copies to the shippers using the facility.
6. NRMP is directed to pay fees to the BCUC in the amounts that the BCUC determines are required to defray costs associated with the regulation of NRMP facilities.
