Extension Request to File the 2019 Rate Application

ORDER

WHEREAS:

 

A.       On August 16, 2019, Boralex Ocean Falls Limited Partnership’s (Boralex) filed a letter requesting an extension to the filing date of its rate application to no later than September 30, 2019 (Extension Request);

B.       On August 29, 2017, British Columbia Hydro and Power Authority (BC Hydro) filed with the British Columbia Utilities Commission (BCUC) an application requesting the BCUC set a rate for Boralex’s electricity service to BC Hydro;

C.       Following unsuccessful negotiations between BC Hydro and Boralex and a BCUC comments process, the BCUC issued Order G-143-19, exempting Boralex from application of the Utilities Commission Act except for certain sections, only in respect to BC Hydro. The BCUC also approved an interim rate, equal to that of the existing Electricity Purchase Agreement, effective July 1, 2019, and directed Boralex to file its rate application by August 30, 2019;

D.       On August 20, 2019, the BCUC sought comments from all participants on whether Boralex should be granted an extension. No participants opposed the extension; and

E.        The BCUC has reviewed the Extension Request and comments filed in the matter and considers that an extension is warranted.

 

NOW THEREFORE, pursuant to sections 58 to 61 of the Utilities Commission Act, the BCUC approves the Extension Request and directs Boralex to file its rate application no later than September 30, 2019.
