Application for 2019 Letter Agreement with Powerex Corp.

ORDER

WHEREAS:

 

A.      On August 2, 2019, British Columbia Hydro and Power Authority (BC Hydro) filed an application with the British Columbia Utilities Commission (BCUC) seeking approval of a letter agreement dated June 6, 2019, (2019 Letter Agreement) between BC Hydro and Powerex Corp. (Powerex), pursuant to sections 71 of the Utilities Commission Act (UCA) (Application);

B.      The 2019 Letter Agreement enables BC Hydro to enter into forward electricity purchase transactions by which Powerex agrees to sell and deliver and BC Hydro agrees to purchase and receive wholesale electricity (Agreement);

C.      The Agreement is a long-term arrangement in effect until terminated by either party;

D.      By Order G-61-12 dated May 17, 2012, the BCUC established the Rules for Energy Supply Contracts (ESC) for Electricity (Rules). The Rules are intended to facilitate the BCUC’s review of ESCs and proposed ESCs for electricity; and

E.       The BCUC has commenced the review of the Application and considers that a regulatory timetable should be established.

 

NOW THEREFORE pursuant to section 71 of the UCA, the BCUC orders as follows:

 

1.       The establishment of a public hearing process in accordance with the regulatory timetable, as set out in Appendix A to this order.

2.       BC Hydro is directed to publish this order and the attached regulatory timetable on its website and provide email notice to all registered interveners in the BC Hydro F2020 to F2021 Revenue Requirements Application within 5 business days of the date of this order.

3.       In accordance with the BCUC’s Rules of Practice and Procedure, parties who wish to participate as interveners in the proceeding are to register with the BCUC by completing a Request to Intervene form by the date established in the regulatory timetable attached as Appendix A to this order.
