Application for Approval of an Operating Agreement

between the Corporation of the City of Enderby and FortisBC Energy Inc.

ORDER

WHEREAS:

 

A.      On August 29, 2019, FortisBC Energy Inc. (FEI) filed an application with the British Columbia Utilities Commission (BCUC) for approval of an operating agreement dated August 16, 2019, entered into between the Corporation of the City of Enderby (City of Enderby) and FEI (FEI-Enderby Operating Agreement or Application);

B.      FEI (through predecessor company BC Gas Utility Ltd.) and the City of Enderby entered into a franchise agreement dated June 16, 1998 and approved by BCUC Order C-10-98 dated June 25, 1998, which expired on September 5, 2019;

C.      FEI submits that the FEI-Enderby Operating Agreement is consistent with the approved terms of the Village of Keremeos Operating Agreement, and with recent changes directed by the BCUC in Order G-81-19 and later approved by Order G-99-19;

D.      In its Application, FEI requests interim approval of the FEI-Enderby Operating Agreement prior to the expiry of the existing agreement, pending the outcome of the proceeding;

E.       By Order G-215-19 dated September 9, 2019, the BCUC issued interim approval of the FEI-Enderby Operating Agreement;

F.       By Order G-228-19 dated September 23, 2019, the BCUC established a public hearing process for the review of the Application, which included a public notice, intervener registration and a deadline for letters of comment;

G.     By letter dated October 18, 2019, FEI requested that the BCUC amend the deadline for intervener registration and letters of comment to November 8, 2019; and

H.      The Panel has reviewed the request and considers the following determinations are warranted.

 

NOW THEREFORE under section 23(1)(g) of the Utilities Commission Act, the BCUC orders as follows:

 

1.       The regulatory timetable is amended, as set out in Appendix A to this order.

2.       FEI must publish, no later than Friday, October 25, 2019, on their website and in display-ad format, the Public Notice attached as Appendix B to this order. Publication should be in such appropriate news publications as may properly provide adequate notice to FEI customers in the City of Enderby.

OPERATING AGREEMENT BETWEEN THE CITY OF ENDERBY
AND FORTISBC ENERGY INC.

 

On August 29, 2019, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC) for approval of an operating agreement with the City of Enderby. The operating agreement between both parties outlines the terms of administering and operating gas distribution facilities within the City of Enderby.
