FortisBC Energy Inc. Application for Approval of an Operating Agreement
Between the Corporation of the City of Enderby and FortisBC Energy Inc.

ORDER
WHEREAS:
A. On August 29, 2019, FortisBC Energy Inc. (FEI) filed an application with the British Columbia Utilities Commission (BCUC) for approval of an operating agreement dated August 16, 2019, entered into between the Corporation of the City of Enderby (City of Enderby) and FEI (the FEI-Enderby Operating Agreement or Application);
B. FEI (through predecessor company BC Gas Utility Ltd.) and the City
of Enderby entered into a franchise agreement dated June 16, 1998 approved by
BCUC Order C-10-98, which is set to expire on
September 5, 2019;
C.
FEI submits that the FEI-Enderby Operating
Agreement is consistent with the approved terms of the Village of Keremeos
Operating Agreement, and with recent changes directed by the BCUC in
Order G-81-19 and later approved by Order G-99-19;
D. By Order G-215-19, the BCUC granted interim approval of the FEI-Enderby Operating Agreement, pending a final determination by the BCUC on the Application;
E. By Order G-228-19 dated September 23, 2019, and as amended by Order G-251-19 dated October 22, 2019, the BCUC established a public hearing process for the review of the Application, which included public notice, intervener registration and a deadline for letters of comment. No requests to intervene or letters of comment were received by the BCUC; and
F. The Panel has reviewed the Application and considers the following determination is warranted.
NOW THEREFORE pursuant to section 23(1)(g) of the Utilities Commission Act, the BCUC orders that the FEI-Enderby Operating Agreement, dated August 16, 2019 between FEI and the City of Enderby, be approved on a permanent basis.
