ORDER

WHEREAS:

 

A.      On October 2, 2019, the British Columbia Utilities Commission (BCUC) issued a confidential order and Notice of Penalty to British Columbia Hydro and Power Authority (BC Hydro) for the four Critical Infrastructure Protection (CIP) standard contraventions of Mandatory Reliability Standards noted above;

B.      On October 2, 2019, the BCUC ordered BC Hydro to make submissions with respect to the release of confidential materials from this proceeding;

C.      On October 25, 2019, BC Hydro stated in a letter that it was not opposed to making public a redacted version of the Notice of Penalty; and

D.      Following review of BC Hydro’s submission, the Panel considers the release of the redacted Notice of Penalty to the general public is warranted.

 

NOW THEREFORE pursuant to section 125.2(10) and Part 8.1 of the UCA, the BCUC orders the following:

 

1.       The release of the redacted Notice of Penalty to the general public, as contained in Appendix A.

2.       All related material filed in this proceeding shall be held confidential, unless otherwise ordered by the BCUC, given the intent of Critical Infrastructure Protection (CIP) standards is to protect the bulk electric system against cybersecurity compromises that could lead to misoperation or instability, and that information related to an Entity’s non-compliance with CIP standards could potentially be used to compromise or disrupt the bulk electric system.
