ORDER

WHEREAS:

 

A.      On September 11, 2020, CB Powerline Ltd. (CBP) filed an application to the British Columbia Utilities Commission (BCUC) for a Certificate of Public Convenience and Necessity (CPCN) for the Cosens Bay community electrification project (Project) pursuant to sections 45 and 46 of the Utilities Commission Act (Application);

B.      In seeking a CPCN for the Project, CBP requests approval to build, own, operate and maintain an electrical distribution system servicing the community of Cosens Bay on Lake Kalamalka, Regional District of North Okanagan, B.C.;

C.      By Order G-248-20 dated October 5, 2020, the BCUC established a regulatory timetable for the review of the Application, which included dates for intervener registration, BCUC and intervener information requests (IRs) No. 1 and CBP responses to IRs. Order G-248-20 also directed CBP to provide notice of the Application to all affected parties and potentially affected parties by no later than October 21, 2020;

D.      On November 27, 2020, CBP filed a letter (CBP Letter) informing the BCUC that due to an administrative error certain affected parties had not received notice of the Application until November 26, 2020;

E.       The BCUC has reviewed the CBP Letter and determines that an updated regulatory timetable and further notice to affected parties is warranted.

NOW THEREFORE the BCUC orders as follows:

 

1.       CBP is directed to provide notice of this order and the amended regulatory timetable, attached as Appendix A, to all affected parties and potentially affected parties by no later than December 8, 2020. This includes, but is not limited to, all affected parties identified in the CBP Letter.

2.       CBP is directed to submit a list of all parties directly notified of this order by CBP, including the method and date of the notification, by December 10, 2020. CBP is also directed to confirm by December 10, 2020 that a manual check has been completed to ensure that no administrative errors have occurred in the delivery of the notice and that no messages or notices of non-delivery were received by CBP.
