ORDER

WHEREAS:

 

A.      On September 16, 2020, Parkland Corporation (Parkland) filed an application with the British Columbia Utilities Commission (BCUC) for an advance ruling on confidentiality for certain commercial information that Parkland is required to file under the Fuel Price Transparency Act (FPT Act) and Regulation;

B.      By Order G-275-20, dated October 30, 2020, the BCUC provided advanced approval of confidential status to fuel data submitted by Responsible Persons pursuant to the FPT Act, that the Responsible Persons identify as Protected Information, until the completion of a hearing process to establish a framework for the determination of confidentiality and treatment of Protected Information (Framework);

C.      By Orders G-303-20, G-68-21, G-159-21, G-214-21, G-260-21, and G-282-21, the BCUC established and further amended the regulatory timetable for development of the Framework. The regulatory timetable included intervener registration; an initial round of written submissions; issuance of Framework Draft No. 1, followed by an oral workshop and written submissions; issuance of Framework Draft No. 2, followed by two oral workshops and written submissions; and Final and Reply Argument;

D.      By January 6, 2021, Suncor Energy Inc., Husky Energy, Tidewater Midstream and Infrastructure Ltd., Federated Co-operatives Limited, Qathet Living Magazine (formerly Powell River Living Magazine), AFD Petroleum Ltd., 7-Eleven Canada Inc., Imperial Oil, Shell Canada Limited, G&B Fuels Inc., and the British Columbia Old Age Pensioners’ Organization et al. (BCOAPO) registered as interveners;

E.       The following participant filed a Participant Assistance/Cost Award (PACA) application with the BCUC with respect to their individual participation in the proceeding:

F.       The BCUC has reviewed BCOAPO’s PACA application in accordance with the criteria and rates set out in the PACA Guidelines attached to Order G‑97‑17 and considers that approval of the cost award is warranted.

 

NOW THEREFORE pursuant to section 118(1) of the UCA, the BCUC orders that funding is awarded to the following intervener in the listed amount for their participation in the proceeding:
