ORDER
WHEREAS:
A. On December 1, 2021, FortisBC Energy Inc. (FEI) filed with the British Columbia Utilities Commission (BCUC) a copy of a fully executed GasEDI Base Contract negotiated with Spotlight Energy LLC (FEI-Spotlight GasEDI Contract) including amendments to the general terms and conditions of the GasEDI Base Contract (Filing);
B. By Order G-130-06 dated October 27, 2006, the BCUC approved the Rules for Natural Gas Energy Supply Contracts (Rules). The Rules are intended to facilitate the BCUC’s review of natural gas energy supply contracts pursuant to section 71 of the Utilities Commission Act;
C. By Order G-79-01 and Order G-197-11 dated July 20, 2001 and November 28, 2011 respectively, the BCUC approved amendments to Rate Schedule 30, which contains the Gas Electronic Data Interface (GasEDI) base contract and FEI’s set of Standard Provisions, which are used by FEI as the starting point for negotiation with counterparties in its gas contracting;
D. By Order G-58-20 dated March 19, 2020, the BCUC approved the most recent amendments to FEI’s Standard Provisions in Rate Schedule 30;
E. By Letter L-14-21 dated June 3, 2021, the BCUC accepted FEI’s 2021/22 Annual Contracting Plan;
F. FEI requests that the details of the Filing be kept confidential to ensure its ability to obtain favourable commercial terms in future gas contracts will not be impaired; and
G. The BCUC has reviewed the Filing and is satisfied that the FEI-Spotlight GasEDI Contract is in the public interest.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the BCUC’s Rules for Natural Gas Energy Supply Contracts, the BCUC orders as follows:
1. The FEI-Spotlight GasEDI Contract dated November 4, 2021 is accepted as filed.
2. The BCUC will keep the Filing confidential as it contains commercially sensitive information.
