ORDER
WHEREAS:
A. On February 7, 2022, pursuant to sections 58 to 61 of the Utilities Commission Act (UCA), British Columbia Hydro and Power Authority (BC Hydro) filed an application with the British Columbia Utilities Commission (BCUC) seeking approval of Tariff Supplement No. 102 (TS 102) between BC Hydro and Richmond Plywood Corporation Ltd. (Richply) for service to its facilities located in Richmond, BC (Application);
B. By Order G-63-01 dated June 14, 2001, the BCUC approved a special tariff agreement between BC Hydro and Richply, in the form of Tariff Supplement No. 58 (TS 58), to allow Richply to take service under Rate Schedule (RS) 1821 (now RS 1823) while being served at distribution voltage from BC Hydro’s Cambie Substation (CAM);
C. By Order G-63-01, the BCUC approved TS 58 to be effective for 20 years, commencing July 1, 2001 and ending June 30, 2021;
D. Prior to the expiry of TS 58, BC Hydro and Richply entered into discussions for a transition agreement intended to recover BC Hydro’s incremental costs associated with Richply’s service prior to Richply moving to an applicable General Service rate under BC Hydro’s Electric Tariff;
E. By Order G-199-21 dated June 28, 2021, the BCUC approved Richply’s eight-month extension request of TS 58 (expiring February 28, 2022) to allow BC Hydro and Richply additional time to determine the terms and conditions of TS 102 (Transition Tariff Agreement);
F. By Order G-54-22 dated February 22, 2022, the BCUC approved a subsequent extension request to allow TS 58 to continue to be in effect until such time the BCUC renders its final determination regarding the Application;
G. Under TS 102, Richply will continue to be billed under RS 1823, which includes other applicable Transmission Service rates and a monthly rider charge to recover BC Hydro’s incremental costs associated with providing service to Richply;
H. By letter dated January 12, 2022, Richply confirmed it had reviewed the Application and stated its support for approval of TS 102; and
I. The BCUC has reviewed the Application and determines that establishment of a public hearing is warranted.
NOW THEREFORE the BCUC orders as follows:
1. A public written hearing process is established in accordance with the regulatory timetable, as set out in Appendix A to this order.
2. BC Hydro must provide an electronic copy of the Application and this order to all affected parties and potentially affected parties by no later than Friday, March 25, 2022.
3. Any party wishing to provide comments on the Application is invited to submit a letter of comment, by the date established in the attached regulatory timetable. Letters of comment must be in the Letter of Comment form available on the BCUC’s website at: https://www.bcuc.com/Forms/LetterOfComment or by mail to the BCUC, Suite 410, 900 Howe Street, Vancouver, BC, V6Z 2N3.
