ORDER
WHEREAS:
A. On April 5, 2022, Gitga’at First Nation (GFN) filed a complaint with the British Columbia Utilities Commission (BCUC) concerning charges billed by British Columbia Hydro and Power Authority (BC Hydro) (Complaint);
B. By Order G-272-22, dated September 28, 2022, the BCUC established a public hearing and regulatory timetable for review of the Complaint;
C. By letter dated September 29, 2022, GFN requested a BCUC order granting GFN eligibility for a cost award in the Complaint pursuant to Rule 34.03 of the BCUC’s Rules of Practice and Procedure (PCA Eligibility Request);
D. By letter dated October 4, 2022, the BCUC requested that BC Hydro file any submissions in response to GFN’s PCA Eligibility Request by October 11, 2022;
E. BC Hydro did not file a response to the PCA Eligibility Request; and
F. The BCUC, having reviewed GFN’s PCA Eligibility Request, finds the following determination is warranted.
NOW THEREFORE the BCUC orders that GFN is eligible for a cost award in the Complaint.
