ORDER
WHEREAS:
A. On September 23, 2022, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval and endorsement of Tariff Supplement K-2 containing an amended and restated Biomethane Long Term Large Volume Interruptible Sales Agreement (Agreement) between FEI and City of Vancouver (CoV), to transfer service from under Rate Schedule 11B - Biomethane Large Volume Interruptible Sales (RS 11B) to service under Rate Schedule 3B – Large Commercial Biomethane Service (RS 3B) and Rate Schedule 5B - General Firm Biomethane Service (RS 5B), effective November 1, 2022 (Application);
B. By Order G-212-18 dated November 8, 2018, the BCUC approved the RS 11B Tariff Supplement K-2 Biomethane Long Term Large Volume Interruptible Sales Agreement between FEI and CoV on a permanent basis, effective October 1, 2018;
C. In August 2022, CoV notified FEI of its intention to transfer its accounts from service under RS 11B to FEI’s bundled service under RS 3B and RS 5B for its accounts where Biomethane is purchased under Tariff Supplement K-2;
D. On October 13, 2022, FEI submitted responses to BCUC Staff questions dated October 5, 2022. FEI noted that a term in the Agreement was inadvertently modified and filed a correction to the tariff supplement. The Commencement Date of October 1, 2018 and the Expiry Date of September 30, 2023 in the Agreement should have remained the same as original; and
E. The BCUC has reviewed the Application and associated documents and finds that approval of the Application is warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The FEI Application to amend Tariff Supplement K-2 regarding the Biomethane Long Term Large Volume Interruptible Sales Service Agreement between FEI and CoV is approved, as amended, effective November 1, 2022.
2. FEI is directed to file with the BCUC the executed version of the Agreement within 15 days of issuance of this Order.
