Section 71 Filing of Propane Supply Agreement Between

FortisBC Alternative Energy Services Inc. (FAES) and Superior Gas Liquids Partnerships (Superior)

ORDER

WHEREAS:

 

A.      On November 25, 2022, Resort Gas Ltd. (Resort Gas), filed with the British Columbia Utilities Commission (BCUC) for acceptance, a propane supply agreement dated February 25, 2022, between Resort Gas and Superior Gas Liquids Partnerships (Superior) through FortisBC Alternative Energy Services Inc. (FAES) to supply Sun Peaks with propane for the period from April 1, 2022 to March 31, 2024 (Agreement);

B.      Sun Peaks Utilities Co. Ltd. (SPUCL) contracted with DESCO Distributed Energy Services Co. Ltd. (now known as FAES) to provide propane vapour distribution technical services, propane supply, and propane storage and vaporization facilities to service the resort community at Sun Peaks as noted in Order C-11-98, dated June 25, 1998;

C.      By Order G-161-17, dated October 24, 2017 the BCUC approved the sale to Resort Gas of all the assets and liabilities relating to the gas utility operated by SPUCL;

D.      By Order E-7-20 dated March 26, 2020, the BCUC accepted a propane supply agreement between Resort Gas and Superior through FAES to supply Sun Peaks with propane for the period from April 1, 2020 to March 31, 2022;

E.       Resort Gas requests that the filing including the Agreement remain confidential due to their commercially sensitive nature; and

F.       The BCUC reviewed the filing and considers that approval is warranted.

 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the BCUC’s Rules for Natural Gas Energy Supply Contracts, the BCUC orders the following:

 

1.       The BCUC accepts for filing the executed copy of the Propane Supply Agreement between Resort Gas and Superior through FAES for the supply of propane to Sun Peaks, effective April 1, 2022.

2.       The BCUC will keep the filing including the Agreement confidential as requested by Resort Gas due to their commercially sensitive nature.
