ORDER

WHEREAS:

 

A.      On March 31, 2023, Creative Energy Vancouver Platforms Inc. (Creative Energy) filed with the British Columbia Utilities Commission (BCUC) an application seeking approval of an updated Fuel Cost Adjustment Charge (FCAC) of $19.40 per thousand pounds steam (/M#) from 19.90/M# effective May 1, 2023 to October 31, 2023. Further, Creative Energy requests approval of a FCAC Rate Rider of $2.00/M# effective May 1, 2023 to December 31, 2023;

B.      By Order G-97-23 and G-195-23 established a regulatory timetable for proceeding, which included public notice, intervener registration, BCUC and intervener information requests, Creative Energy responses to information requests, submissions on further process and final and reply arguments;

C.      On May 25, 2023, the Commercial Energy Consumers Association of BC (CEC) registered as the sole intervener for this proceeding;

D.      On October 20, 2023, the BCUC issued a Decision and Order G-283-23 approving the FCAC rate of $19.40/M#, effective May 1, 2023 to October 31, 2023 and the FCAC Rate Rider of $2.00/M#, effective May 1, 2023 to December 31, 2023 on a permanent basis;

E.       The following participants filed Participant Cost Award (PCAapplications with the BCUC with respect to its participation in the proceeding:

F.       On December 5, 2023, Creative Energy submitted that it did not have any comment on CEC’s PCA for this proceeding.

G.      The BCUC has reviewed the PCA application in accordance with the criteria and rates set out in the BCUC’s Rules of Practice and Procedure for Participant Cost Awards, attached to BCUC Order G-72-23, and concludes that the cost award as applied for should be approved. 

 

NOW THEREFORE pursuant to section 118(1) of the Utilities Commission Act, the BCUC orders as follows:

 

1.       Funding is awarded to CEC in the amount listed below for its participation in this proceeding:

2.       Creative Energy is directed to reimburse CEC for the awarded amount in a timely manner.
