WHEREAS:
on September 10, 2024 ORDER
A. On July 4, 2024, FortisBC Energy Inc. (FEI) filed an application (Application) with the British Columbia Utilities Commission (BCUC) seeking acceptance, pursuant to section 71 of the Utilities Commission Act (UCA), of executed agreements
(Agreements) and approval, pursuant to sections 59 to 61 of the UCA, of the rate treatment for costs incurred under the Agreements;

C. In the Application, FEI is seeking acceptance of the Agreements and approval to record the costs FEI incurs under the Agreements in the Midstream Cost Reconciliation Account for recovery from customers;
D. By Order G-130-06 dated October 26, 2006, the BCUC approved the Rules for Natural Gas Energy Supply Contracts (Rules). Appendix A of Order G-130-06 contains the Rules, which are intended to facilitate the BCUC’s review of natural gas energy supply contracts, pursuant to section 71 of the UCA;
E. On June 7, 2024, the BCUC accepted FEI’s 2024/2025 Annual Contracting Plan by Letter L-13-24; F. By Order G-194-24 dated July 19, 2024, the BCUC established a regulatory timetable for the review of the Application, which included one round of information requests to FEI and FEI’s final submissions;
G. FEI requests that the Application and associated documents remain confidential due to their commercially sensitive nature; and
H. The BCUC has reviewed the Application and evidence submitted and is satisfied that the Agreements are in the public interest.
NOW THEREFORE pursuant to sections 59 to 61 and 71 of the UCA and the Rules, the BCUC orders as follows: 1. The BCUC accepts the Agreements as filed. 2. FEI is directed to file an executed copy within 60 days of the execution date of each agreement.
3. FEI is approved to record the costs incurred under the Agreements in the Midstream Cost Reconciliation Account for recovery from customers.
4. FEI is directed to file an update in future Annual Contracting Plans 5. The redacted portions of this order and all related material filed in this proceeding shall be held confidential until the BCUC determines otherwise.
