ORDER

WHEREAS:

 

A.      On September 15, 2024, Golden Key Resort Ltd. (GKR), filed an application (Application) with the British Columbia Utilities Commission (BCUC) pursuant to section 88(3) of the Utilities Commission Act (UCA) seeking approval for exemption from section 71 and Part 3 of the UCA, except sections 38 and 42, in respect of the sale of electricity to customers of the Cottonwood Meadows Recreational Vehicle Park (the Park) located in Chilliwack, British Columbia;

B.      Under the UCA, a public utility is defined in section 1, in part, as:

A person, or the person’s lessee, trustee, receiver or liquidator, who owns or operates in British Columbia, equipment or facilities for the (a) production, generation, storage, transmission, sale, delivery or provision of electricity, natural gas, steam or any other agent for the production of light, heat, cold or power to or for the public or a corporation for compensation;

C.      GKR operates the Park, which consists of 125 pads designed to accommodate wheeled recreational vehicles, on land leased from the City of Chilliwack and zoned for outdoor recreation;

D.      GKR provides services, including electricity, to customer vehicles. Electrical equipment, including underground cables and meters, has been installed at the Park to facilitate this service offering. Customers staying at the Park for one month or longer are billed for electricity at a flat rate of $0.1344/kWh; and

E.       The BCUC determines that the establishment of a public hearing process to review the Application is warranted.

 

NOW THEREFORE the BCUC orders as follows:

 

1.       A regulatory timetable is established, as set out in Appendix A to this order.

2.       GKR is directed to post, no later than November 22, 2024, a copy of this order and the public notice attached as Appendix B to this order on its website at: www.cottonwoodrvpark.com and on any public notice boards located at the Park. The postings must remain in place until a final determination on the Application has been issued.

3.       GKR is directed to provide the BCUC with confirmation that it has posted the order and notice as required in Directive 2 by November 29, 2024.

Golden Key Resort Ltd. Exemption under Section 88(3) of the UCA

Golden Key Resort Ltd. (GKR) operates the Cottonwood Meadows Recreational Vehicle Park (the Park). As part of the services provided at the Park, GKR resells electricity it purchases from the British Columbia Hydro Authority (BC Hydro) to its customers.

 

GKR has applied to the British Columbia Utilities Commission (BCUC), pursuant to section 88(3) of the Utilities Commission Act (UCA), for an exemption from section 71 and Part 3 of the UCA, except for sections 38 and 42 (Application). Part 3 of the UCA sets out the BCUC’s jurisdiction to regulate public utility operations in BC.
