Participant Cost Award Application

ORDER

WHEREAS:

 

A.      On October 31, 2023, Creative Energy Mount Pleasant Limited Partnership (CEMP) filed with the British Columbia Utilities Commission (BCUC), pursuant to sections 58 to 61 and 90 of the Utilities Commission Act (UCA), its application for rates for the Mount Pleasant District Cooling System effective January 1, 2024 through December 31, 2026 (2024-2026 RRA);

B.      By Orders G-350-23, G-12-24, G-57-24, G-114-24, G-129-24, G-184-24, and Letter dated June 19, 2024, the BCUC established and amended the regulatory timetables for the review of the 2024-2026 RRA, which included three rounds of BCUC and intervener information requests, two requests for submissions, a request for supplemental information, and written arguments;

C.      The Commercial Energy Consumers Association of British Columbia (the CEC) participated as the sole intervener in the proceeding;

D.      By Order G-265-24 and the accompanying decision dated October 21, 2024, the BCUC issued its final decision on the 2024-2026 RRA. As part of that decision, the BCUC directed CEMP to record 85 percent of any costs awarded to the CEC for its participation in the proceeding for recovery from CEMP’s ratepayers;

E.       On October 28, 2024, the CEC filed a Participant Cost Award (PCA) application with the BCUC seeking $14,896.11 with respect to its participation in the proceeding;

F.       CEMP did not file any comments on the PCA application; and

G.      The BCUC has reviewed the PCA application in accordance with the criteria and rates set out in the BCUC’s Rules of Practice and Procedure and makes the following determinations.

 

NOW THEREFORE pursuant to section 118 of the UCA, the BCUC orders as follows:

 

1.       Costs are awarded to the CEC in the listed amount below for its participation in the 2024-2026 RRA proceeding:

2.       CEMP is directed to reimburse the CEC for the awarded amount in a timely manner.
