CONSENT ORDER

[1]       In the Condominium Authority Tribunal’s (the “CAT”) online dispute resolution system, the Parties agreed to settle this case in Stage 2 – Mediation.

[2]       Under Rule 34.3 of the CAT’s Rules of Practice, the CAT can close a case in Stage 2 – Mediation if the Parties agree to the CAT making a consent order that resolves the dispute.

[3]       With the consent of the Parties, the CAT orders that this case has been resolved, based upon the terms and conditions set out in this consent order.

ORDER

[4]       The Respondent agrees to properly ratified minutes that clearly record the missing decisions, discussions, and votes for the awarding of both the cleaning contract and the parking garage repair work. The Corporation agrees to produce the Board Meeting Minutes dated March 11, 2026, within 14 days of the date of this consent order.

[5]       The Applicant and Respondent agree to wave the confidentiality of all documents shared in Stage 1 – Negotiation and Stage 2 – Mediation.

[6]       The Parties agree that the settlement discussions during Stage 1 – Negotiation and Stage 2 – Mediation will be confidential only to the extent that the written messages cannot be distributed or shared with third parties verbatim, in whole or in part. Nothing in this Consent Order restricts the Parties from discussing any views or concerns arising from this Application, including regarding the Corporation's governance and the award of contracts, with any third party.

COMPLIANCE

[7]       If any of the Parties fails to comply with any of the terms of this order, it may be enforced through the Ontario Superior Court of Justice.
