Dear Registrar: Re: Alexander MARTIN v ALPHABET INC. et al (CT-2025-004) This is to certify pursuant to section 103.1 of the Competition Act that the above-captioned matter is not the subject of an inquiry nor was it the subject of an inquiry that has been discontinued because of a settlement between the Commissioner of Competition and the persons against whom an order is sought.

We wish to bring to the Tribunal’s attention that the Commissioner previously discontinued an inquiry, which, in part, investigated a related issue. 1 Following the investigation, Google provided commitments to the Commissioner with respect to a different issue under that inquiry, namely its AdWords Application Programming Interface (API) Terms and Conditions, which do not appear to be the subject of the present application.
